Terms of Service — Xen Wheels

This website is operated by Xen Wheels ("Xen Wheels," "we," "us," or "our"). Throughout the site, the terms "we," "us," and "our" refer to Xen Wheels. By visiting our site and/or purchasing something from us, you ("you," "your," or "customer") engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including the additional terms, conditions, and policies referenced herein and available by hyperlink (such as our Refund Policy, Shipping Policy, and Privacy Policy).

Please read these Terms of Service carefully before accessing or using our website or placing an order. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any Service.

1. General Conditions

You must be at least 18 years of age, or the age of majority in your state or province of residence, to place an order with us. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

We reserve the right to refuse service to anyone for any reason at any time. We reserve the right to change, suspend, or discontinue any part of the Service at any time without notice.

You understand that your content (not including payment information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Payment information is always encrypted during transfer over networks.

2. Products — Custom and Made to Order

Xen Wheels manufactures bespoke forged wheels that are custom-built to order based on the specifications you select or provide, including but not limited to size, finish, material, construction, bolt pattern (PCD), offset, and fitment.

You acknowledge and agree that:

  • Each set is produced specifically for you and is not a stock or off-the-shelf item.
  • Because products are made to order, production begins shortly after your order is confirmed, and cancellation rights are limited as described in our Refund Policy and in Section 6 below.
  • Colors, finishes, and product images displayed on the website are for illustration. Actual finishes may vary slightly due to materials, lighting, and screen settings, and such variation is not a defect.
  • It is your responsibility to confirm the correct fitment specifications (vehicle, size, bolt pattern, offset, brake clearance, and load rating) for your application before ordering. We are happy to assist, but final responsibility for verifying fitment rests with you.

3. Fitment, Installation, and Use

Wheels must be installed by a qualified professional using proper equipment, torque specifications, and hardware. You agree that:

  • Xen Wheels is not responsible for improper installation, incorrect torque, use of incompatible hardware, or modifications made after delivery.
  • Products are sold for use within their rated specifications. Misuse, overloading, motorsport or off-road use beyond a product's rating, curb or impact damage, and improper maintenance are not covered by any warranty.
  • You are responsible for ensuring that any wheel and fitment is legal and appropriate for the jurisdiction and manner in which the vehicle is operated.

4. Pricing and Payment

All prices are listed in U.S. Dollars (USD) unless otherwise stated. Prices, product descriptions, and availability are subject to change without notice.

We make every effort to display accurate pricing. In the event a product is listed at an incorrect price due to typographical or system error, we reserve the right to refuse or cancel any orders placed for the incorrectly priced product, whether or not the order has been confirmed and payment processed. If your payment has already been charged for an order that is cancelled, we will issue a refund of the incorrectly charged amount.

Payment must be received in full before production begins unless a separate written deposit or payment arrangement has been agreed. By submitting payment information, you represent that you are authorized to use the payment method provided.

5. Orders and Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, for any reason.

We may require additional verification or information before accepting any order, particularly for high-value orders. We reserve the right to limit quantities purchased per person, per household, or per order.

6. Cancellations and Changes

Because products are manufactured to order:

  • Cancellations are accepted only within 24 hours of order placement, provided production has not yet begun. After production begins, orders cannot be cancelled.
  • Changes to specifications (size, finish, fitment, etc.) may be accommodated only before production begins and may be subject to price adjustment.

Please refer to our Refund Policy for full details on returns, refunds, restocking fees, and damaged-shipment procedures, which are incorporated into these Terms by reference.

7. Shipping and Delivery

Production lead times, shipping times, international availability, customs and duties, and signature requirements are described in our Shipping Policy, which is incorporated into these Terms by reference.

Title and risk of loss for products pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our reasonable control. Any import duties, taxes, or customs fees are the responsibility of the customer.

8. Warranty and Disclaimer

Any limited warranty we provide applies only to manufacturing defects in materials and workmanship, under normal use within the product's rated specifications, and is subject to the conditions stated at the time of sale. The warranty does not cover damage resulting from accidents, impacts, curb rash, improper installation, improper maintenance, modification, racing or off-road use beyond rating, corrosion from environmental exposure, or normal wear.

EXCEPT AS EXPRESSLY STATED, THE SERVICE AND ALL PRODUCTS DELIVERED TO YOU ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no case shall Xen Wheels, its directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages arising from your use of any product or the Service.

To the extent any liability is found, our total aggregate liability shall not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Xen Wheels and our affiliates, partners, officers, directors, agents, contractors, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

11. Accuracy of Information

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on the material on this site is at your own risk.

12. Intellectual Property

All content on this website, including text, graphics, logos, images, product designs, and the "XEN" name and mark, is the property of Xen Wheels or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written permission.

13. Third-Party Links and Tools

The Service may provide access to third-party tools or links to third-party websites over which we have no control. We provide these on an "as is" basis without warranties and are not responsible for the content or practices of any third-party sites or services.

14. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Governing Law

These Terms of Service and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

16. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check this page periodically. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

17. Severability

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed; such determination shall not affect the validity and enforceability of any other remaining provisions.
